Legislating From the Bench

The Supreme Court of the United States was established, as were the Executive branch and the Congress (the legislative branch), by the U.S. Constitution in Article III, Section 2. The Justices were to serve for life, unless they were found to be corrupt, and had very limited power. Their role was meant to be one that kept the other two branches of the government in check. Over the years, however, the political leanings of the justices has taken on a significant role in the proceedings and decisions of the Court. Molding societal mores has been an unfortunate outcome of the decisions of the liberal members of the Court. They have decided matters according to their political bent, making the Constitution’s wording fit their moral opinions. Remember that this document was written after much prayer by men who were primarily God-fearing. It would lay the foundation for a Republic that acknowledged and honored God.

He has told you, O man, what is good; and what does the LORD require of you but to do justice, and to love kindness, and to walk humbly with your God?” (Micah 6:8; ESV)

Give Him 15 minutes in prayer:

  • Identificationally repent for the manipulation of our founding document by some of our former Supreme Court Justices. (Read Daniel 9 for an example of national identificational repentance.)
  • Ask God to give us judges as at the first – men and women who honor Him and will limit themselves to acting within the powers of the Constitution.
  • Intercede for the current 9 Supreme Court Justices to rule in accordance with the Constitution.
  • Pray that God would be honored in every governmental office in America.

A prayer you can pray:

Father, hear my cry for mercy for America and our Courts. We have been wicked and rebelled; we have turned away from Your commandments and Your laws. Our judges have sinned against You and have dishonored the system of government You led us to establish. We need You to set things right, Lord. Change out every single Judge You need to until the Court is set with those who will honor You and the Constitution in their decisions. In the meantime, Holy Spirit, guide the decisions of the nine justices currently on the Court to keep themselves reigned in. Let them not rule with political motivation, with an eye to reconstruct our society by legislating from the bench. That is not their role! May God be honored in every governmental office in our land! Thank you, Jesus. Amen.

Past Regrets

Now and then a President is absolutely sure he has found the perfect nominee as a Justice of the Supreme Court. Sometimes, it turns out that person reveals themselves to not be who the President thought they would be. While we want a strong supporter of the Constitution, that can mean different things to different justices. Sometimes, they simply change their views over time. For example, President Eisenhower called Chief Justice Earl Warren the biggest mistake he ever made. Warren ruled in Brown v Board of Education on behalf of segregating public schools. A number of Republican appointees to the Court have been much more moderate than their appointing presidents ever imagined them to be, including the retiring Anthony Kennedy. They sided with the liberal end of the Court on abortion and gay marriage cases. For our children’s future in America, we can’t bear another mistake like that.

There is a way which seems right to a man, but its end is the way of death.” (Proverbs 14:12; NASB)

Give Him 15 minutes in prayer:

  • If our Senate ever needed discernment, it is in the confirmation process of a Supreme Court Justice. Pray.
  • Declare that our nation will not accept another generation of unrighteous, unholy Supreme Court decisions.
  • Decree that our children will not reap the fruit of our generation’s missteps in choosing a Supreme Court Justice.
  • Prophetically open the door to the vacant Supreme Court seat to the one of God’s own choosing and close it to anyone else. (Isaiah 22:22)

A prayer you can pray:

God, our President has made his choice. Now, it is up to our Senate to see what Brett Kavanaugh is truly made of. Don’t let politics blind their view of him. We, as representatives of the United States of America, will not accept anyone who will align themselves with the enemies of God. We won’t accept decisions that kill infants in the womb or that put stamps of approval on immoral lifestyles. We refuse to leave a United States like that to our children and children’s children. We want to turn the battle at the gate now, in our generation! We say that the vacant Supreme Court seat is only open to the one of God’s own choosing and close it to anyone else. In the name of Jesus Christ, amen.

What Happens Next?

Many Christians are wondering what happens next to confirm a Supreme Court nominee? This is a good time for a lesson on government processes. First of all, the basics come right out of the Constitution of the United States. The President considers recommendations from many sources, then he makes a decision on the one individual he believes will be the best choice. Once he has announced his nominee, all kinds of background checks and record collections will commence. There will be a few one-on-one meetings between the nominee and some key senators. The Senate Judiciary Committee will have all of this information gathered and presented to them for review and they will set a date for a hearing. Then, they will hold the hearing in which they can question (scrutinize) the nominee. Witnesses may be called to support or oppose the nominee, testifying regarding their personal character or prior actions on the bench. Finally, the Senate Judiciary Committee votes on the nominee and refers the matter to the full Senate for a vote. This could be a recommendation to confirm, to reject, or may go without an opinion. The full Senate debates and votes on the nominee, making a final decision. This whole process usually takes between 25 and 125 days. (To learn more click here.)

Give Him 15 minutes in prayer:

  • Learn all you can about governmental processes. They can provide timelines for prayer and other needed information. Here is information about the Supreme Court confirmation process. Here are the members of the Senate Judiciary Committee.
  • Pray for the timing of the Senate Judiciary Committee’s hearing.
  • Pray for the senators on the Committee to investigate thoroughly and know if Judge Kavanaugh is fully representing himself and his views. We only want God’s choice on the bench.
  • Ask God to move on the hearts of the senators on the Committee and that they would be led to recommend or not depending on what they discover.

A prayer you can pray:

Father, teach me things I don’t know about our government’s processes. I don’t just need spiritual knowledge. I need knowledge of how the system is designed to work. That knowledge can help me know how to focus my intercession and when to pray. The next step in the process will be a discovery process. This is the critical time where natural knowledge will be presented. Holy Spirit, go to work and make the hearts of these men and women comfortable or uncomfortable as the answers to their questions unfold. Let every hidden thing be revealed. We don’t care about politics. We care about righteousness. We care that the nominee has right standing with You and alignment with Your Word. Grant wisdom and discernment, Jesus. Amen.

Is This the One?

“Through the Church, the manifold wisdom of God is made known to the rulers and authorities at work today (Ephesians 3:10). This is the role of intercessors. This is why and how we pray for the nation. Many organizations and Christian leaders that I respect have endorsed Judge Kavanaugh for very sound reasons: He is a textualist and originalist; he is strong on the Second Amendment, administrative law, and religious liberty; he is an intellectual leader as a jurist. A few Christian leaders that I respect have expressed concern for his appointment: he is part of the establishment; he may be unwilling to reverse Roe v. Wade; prophecies have (raised a question as to whether) he may have a spirit of Absalom, a spirit that would usurp the ways of God.  We desire to hear from the Lord in this manner, as we always do. As we listen to the Spirit in our own hearts and consider prophetic words, we need to test and verify every ‘word’ we receive.” (Dave Kubal)1

Give Him 15 minutes in prayer (Dave Kubal)1:

  • Declare God’s sovereignty over this process, that He is more powerful than any committee, any hearing, any conglomerated media effort, etc.
  • Pray for the revealing of Judge Kavanaugh’s views about critical issues. We need to pray that Judge Kavanaugh’s past decisions would be clearly understood in order to anticipate accurately how future decisions could be made. In particular, God’s heart is for the protection of the unborn, so we must pray that the new Supreme Court Justice will be a person open to the reversal of Roe v. Wade.
  • Protection of senators from outside influences. Targeted millions of dollars will be spent in the next few months in attempts to sway specific senators in this process by getting constituents to pressure their senators. In addition to this public pressure, there will be personal pressure on these same senators.
  • We must pray that our senators have a strong sense of the fear of God instead of the fear of man.
  • Pray that the anti-life/anti-God mainstream and social media would be stifled.

A prayer you can pray:

Lord, we declare that You are more powerful than any committee, any hearing, any conglomerated media effort or any other human decision-making body in our government. You are sovereign and able to ensure that Your choice is seated on the Court. As Judge Kavanaugh goes through the process, reveal his heart and thinking on critical issues. Don’t leave our well-meaning senators in the dark. We really want to know if he stands fully for Life. Protect the senators from bribes and deals that outside influencers may try to make with them. This is an abomination to you, as well as to us. Place the fear of the Lord on them, instead. And, Jesus, shut the mouth of the media! They are really stirring a very ugly pot of divisiveness and control. Thank you, Lord. Amen.

Flailing at Windmills

What did we tell you? This nation is so politically divided that fear and craziness are out in full force! We are talking about the Supreme Court Justice nomination. It doesn’t matter who has been nominated, as we will show you. All that matters is each “side” hates the other and petticoats are showing. “Case in point, the zealots at the Women’s March issued a press release (Monday) night slamming Trump’s pick — whose name they forgot to add! Instead, the statement went out with ‘XX’ where the word ‘Kavanaugh’ should have been, proving that they would have repeated the same garbage no matter who was nominated. The liberal group Democracy for America sent out another embarrassing statement with fill-in-the-blank opposition, assuring people that ‘DFA will fight Kavanaugh,’ because ‘she represents a generational assault on justice, freedom, core democratic values.’”1 This battle is not about a person. It is about the nation’s destiny. We need no more proof than the statements above.

  • Declare that God’s plan will not be stopped!
  • Stop and feel compassion for those who are looking pretty foolish right now.
  • Someone has to take the high road. As Christ-followers, we have to be the ones who do. Intercede for those who don’t understand.
  • Pray God graces our nation with unity and peace that only He can give.

A prayer you can pray:

I decree that the plan that You have for America has been put in motion and nothing will be able to stop it! No man, no opinion of man, no ranting, no raving, no attempt at reputation-tarnishing, and no wrong choices, will adjust Your plan one iota. God, You are God and You are on the move! I feel so sorry for those that are showing their true colors. There are those who are so angry at the current decisions being made that they have been blinded to truth. They aren’t even being careful, as they simply react. The enemy is driving them into fear of the unknown. Let Your Church stand firm and peaceful in this sea of nonsense. Let us stand firm in faith and watch the salvation of our nation. Heal our country as only You can, Jesus—with Your grace and peace. Amen.

Filling Up Empty Seats

We all know by now that there is one available seat on the Supreme Court of the United States, which is being vacated by retiring Justice Anthony Kennedy. Not many of us, however, realize that 17% of all federal court judicial seats are empty. This is a significant number. Just like the Supreme Court justices, all of these judges serve for life, so seating this many judges can have a great impact long into the future. President Trump has been quietly filling all of those empty seats with conservative judges. The Supreme Court hears 70-75 cases a year. The federal appeals courts hear up to 50,000 cases in a year. It is easy to see that cases are often finally decided in the lower Federal Courts of Appeals. “On a number of important constitutional and statutory cases, they’re often the last word,” John Malcolm, director of the Meese Center for Judicial Studies at the Heritage Foundation, says. “So, the people who sit on those courts can have a very large impact on the direction of the law.”1

And the Spirit of the Lord shall rest upon him, the Spirit of wisdom and understanding, the Spirit of counsel and might, the Spirit of knowledge and the fear of the Lord.” (Isaiah 11:2; ESV)

Give Him 15 minutes in prayer:

  • President Trump made a campaign promise he is fulfilling. He promised to seat constitutionally conservative judges on America’s federal courts.  Thank the Lord for presidential promises kept.
  • Pray that every judge called forth by God for this moment in history is placed in their exact right place in the nation’s courts.
  • Intercede for the Senators confirming those to be seated on federal court benches. Pray that the character of these judges is such that opposing senators are not able to impede the progress being made.
  • Ask God for yet another generation of righteous lawyers raised up and made ready for future federal court vacancies.
  • If you are a Christian attorney, fear the Lord and live your life, so you could possibly be one of our nation’s future judges.

A prayer you can pray:

Lord, thank you again for a president who is keeping a campaign promise to fill the 17% vacancy rate on our federal court benches with righteous judges. May President Trump and his team find every single one of those who have been prepared by You to fill those seats. We want our judicial system to honor You at every level, all the way up to the Supreme Court. Let the nominees’ character and judicial activities be without reproach, Jesus, so they cannot be logically rejected. Let young, Christian attorneys be made sensitive to Holy Spirit, living God-fearing lives and studying to show themselves approved. Our nation will need them some day. May the way be made open for their futures in the nation’s federal court system, all the way to the top! In Jesus’ name, amen.

Introducing Judge Brett Kavanaugh

“Mr. President, thank you. Throughout this process, I have witnessed firsthand your appreciation for the vital role of the American judiciary. No president has ever consulted more widely or talked with more people from more backgrounds to seek input about a Supreme Court nomination. Mr. President, I am grateful to you and I am humbled by your confidence in me. Thank you…. My judicial philosophy is straightforward: A judge must be independent and must interpret the law, not make the law. A judge must interpret statutes as written, and a judge must interpret the Constitution as written, informed by history and tradition and precedent.… I (will) begin meeting with members of the Senate which plays an essential role in this process. I will tell each senator that I revere the Constitution. I believe that an independent judiciary is the crown jewel of our constitutional republic. If confirmed by the Senate, I will keep an open mind in every case, and I will always strive to preserve the Constitution of the United States and of the American rule of law.   • Clearly, Judge Kavanaugh is a supporter of the U.S. Constitution who is against the judiciary legislating from the bench. This is something we have asked the Lord for, so thank Him!
  • Intercede for his meetings with key Senators this week. That is the first step in the confirmation process, which He has already begun.
  • Intercede for the Senators he will meet with. Pray they are able to put politics aside and listen carefully to what he will tell them.
  • The political spirit is dividing our nation. Politics touches every area of our lives. Cry out for unity in America and for the well-being of the people to be considered above political agenda.

A prayer you can pray:

Father, we pray that You have provided a person of Your choosing in Judge Brett Kavanaugh. We know he is a family man of stalwart character. You have answered our prayers for a person with a firm commitment to support the Constitution of the United States and who will not legislate from the bench. Thank you. Guide his steps and his words as he has preliminary meetings with various senators this week. We pray that his answers will be clearly heard. Lord, the division in our nation becomes more clear every day, mostly among political lines. We pray that the Church in particular is able to find a place of unity in You! Make us one and heal our land in Jesus’ name. Amen.

You will restore our judges as at the first, and our counselors as at the beginning; then our nation will be called “righteousness”.

And the Supreme Court Nominee Is….

U.S. Circuit Court Judge Brett Kavanaugh is President Trump’s nominee to fill the seat on the Supreme Court vacated by retiring Justice Anthony Kennedy. Judge Kavanaugh is a strong supporter of the U.S. Constitution, as written and amended. He is a practicing Catholic and a God-fearing man. He has taken clear stands for life in his time as a Circuit Court Judge. He feels, as Justice Neil Gorsuch does, that politics should be left out of the Courts. We don’t yet know when the Senate confirmation hearings will be, but we will begin to pray.

“Always think carefully before pronouncing judgment. Remember that you do not judge to please people but to please the Lord. He will be with you when you render the verdict in each case. Fear the Lord and judge with integrity, for the Lord our God does not tolerate perverted justice, partiality, or the taking of bribes.” (2 Chronicles 19:5-7; NLT)

Give Him 15 minutes in prayer:

  • Read everything you can about Judge Brett Kavanaugh.
  • Pray 2 Chronicles 19:5-7 over him. Ask God to reveal anything that may not line up with this scripture, but otherwise to have him quickly confirmed.
  • Pray protection for him and his family. There are groups and individuals in this nation that are not happy with this choice.
  • Ask that the Senate confirmation hearings are scheduled quickly and early enough to leave plenty of time for a good decision to be made.
  • Pray for the Senators that may not agree politically with this pick. Pray they will focus on what matters – strong character, good education, and a clear judicial record over politics.

A prayer you can pray:

Lord, we want the one person You want in that open Supreme Court seat. As I pray 2 Chronicles 19:5-7 over Judge Brett Kavanaugh, reveal anything in his life that may not line up with Your Word. If he is a righteous vessel, then we say, “Let him be seated without delay!” Keep him and his family safe through this season. Send Your holy angels to guard and protect them from any political opponents. Thank you that this man does not play politics, but stands firmly for the US Constitution. Let his strong moral character shut the mouth of every potential accuser. Lord, may he be without reproach, a man of honor and one who glorifies Jesus Christ, whom he serves, so that his confirmation is assured. For the future of our nation and in the name of Jesus, amen.

A Choice That Will Divide the Nation

Can you feel the swirling in the heavenlies? Can you feel the conflict and turmoil? The enemy is not quite sure what to do. He will stir up a panic among the people. Watch for it in the media and among those who fancy themselves to be a spokesperson for the nation. Those who are haters of God will be exposed. Those who would trade righteousness and justice for humanistic agendas will be out in force today. We will pray for them. As they make themselves clearly seen, we will intercede for them. God will Holy-Ghost-highlight them to us for intercession. God’s will for America will be done. No one and nothing can stop it. All the crazy talk will not deter Him from His plan. Watch now and see the righteousness of God at work answering the prayers of the saints. The bowls are being tipped out and our prayers answered for a Supreme Court of the United States of America that honors the U.S. Constitution and God.

Catch the foxes for us, the little foxes that spoil the vineyards, for our vineyards are in blossom.” (Song of Solomon 2:15; ESV)

Give Him 15 minutes in prayer:

  • Fear of loss causes anger and flailing in every direction. This is going to happen with the Supreme Court appointment today. Fast and watch and pray.
  • Wherever you see those in the media attacking President Trump’s choice—even before he annonces the person—intercede for the one doing the attacking. They don’t understand what they are doing. Say, “My children and grandchildren and I forgive you.”
  • Pray for their eyes to be opened to God’s reality and love for them. Intercede for their salvation, if they are not yet brothers and sisters in Christ. What an opportunity for them to receive hundreds of thousands of prayers today!
  • Pray that President Trump will have a supernatural grace to ignore all the taunting and mocking and fear-laden reporting. Let him declare his decision as a president should—with all boldness and confidence that it is the right one for America both now and in the future.

A prayer you can pray:

Father, may we not get caught up in the media’s flailing for words and fear-mongering in advance of President Trump’s announcement of Supreme Court Justice nominee today. May we respond in the opposite spirit – that of compassion for them and prayer for Your peace to descend on their hearts and minds. Many that do this do not know You, Jesus. They are committed to an earthly agenda and don’t understand the solid foundation You are setting in America. It is one that will not harm them, but will give our children and grandchildren hope for the future. It will be a future established on Your wisdom and righteousness, within the boundaries set by the U.S. Constitution. We forgive them. President Trump’s pick will be the right one for this season in history. Amen.

One More Call

Today is the day that President Trump will need to finalize his decision for Supreme Court nominee. He will make the appointment public tomorrow, Monday, July 9. Are you excited? You should be. There is a unique opportunity for the Court to be set as solidly conservative for decades. The exact right person must be appointed. Intercede today with passion for the choice to be in alignment with God’s perfect design. This will be an answer to the prayers of the saints over the last couple of decades for a righteous judges to be seated on the Supreme Court, as at the first.

Trust in the Lord with all your heart and do not lean on your own understanding. In all your ways acknowledge Him, and He will make your paths straight.” (Proverbs 3:5-6; NASB)

Give Him 15 minutes in prayer:

  • Intercede for President Trump today for the decision he must make of an appointment to the Supreme Court seat vacated by Justice Kennedy. Fast in some way, if the Lord leads.
  • Declare Proverbs 3:5-6 over President Trump regarding this decision.
  • Let the chosen person be found seeking the Lord for their response to the President’s invitation. Let them make their heart and mind ready in humility and purity of heart.
  • Decree that the seat is only available to the person of God’s own choosing.

A prayer you can pray:

Father, we intercede today for President Trump. What a weighty decision he must make. He has been given an open door of opportunity to place another conservative justice on the Supreme Court. This is rare. He must make the exact, right choice, as the rulings this person will make will likely affect not just our lives, but the lives of our children and grandchildren. We pray over the president, “Trust in the Lord with all your heart and do not lean on your own understanding. In all your ways acknowledge Him, and He will make your paths straight.” (Proverbs 3:5-6; NASB) Let the one You have chosen make themselves ready today by seeking Your face, Your heart, and Your mind for their answer. Let their humility and purity of heart be seen and heard, so that there is no argument against them. Let this all come to pass by Your grace, Jesus, amen.
